Agricultural & Non-Agricultural Workers
Agricultural. H-2A visas are issued
for agricultural workers and they are treated differently from
other types of temporary workers categories. It can not be issue
to foreign who already is in the United States illegally. The
basic requirements are: (1) The employer must attempt to find
U.S. agricultural workers, (2) The employer must advertised not
only in the employer’s immediate geographical area, but
throughout the entire adjacent region.
Non-agricultural. H-2 B visas are
issued to anyone that comes to United Estates to accept a temporary
or seasonal non-agricultural job, and are aimed at skilled and
unskilled workers. You must have the correct background or skills
abilities needed by the employer, and it must be shown that there
are no qualified Americans available to take the position. A specific
job offer from a U.S. employer is required, and the employer will
have to act as the petitioner in the precess of getting your visa.
The idea it is that the U.S. government is issuing the visa not
for your benefit, but to help the U.S. employer. The job offered
can not be any position, first, it must be temporary; second,
must be one-time seasonal or based on an intermittent need, and
you must return to your home country once the visa expires.
